§ 1 Scope

The use of the football simulation training “lab” is exclusively governed by the following terms of use and the disclaimer of liability.

By signing the registration form, each user confirms that they have read and understood these terms and acknowledge and accept the provisions contained therein.

§ 2 Participation requirements

The use of “skills.lab” is a sporting activity and can be associated with great physical or mental exertion.
Therefore, the use of “skills.lab” requires full physical and mental fitness.

Persons who

  • use electronic medical devices (such as heart pacemakers);
  • are not fit for sport;
  • have diseases or preliminary damage (e.g. eyes, joints, spine) or other physical restrictions; or
  • are under the influence of alcohol, drugs or other substances which impair the fitness for driving or exercise,

are excluded from participation for their own protection.

The minimum age for using “skills.lab” is 10 years. Until the age of majority is reached, a declaration of consent by a legal guardian is required in order to use “skills.lab“.

§ 3 Terms of use

The users may participate at their own risk only. The training with “skills.lab” is only permitted after instruction and under the supervision of the “skills.lab” staff. All instructions of the “skills.lab” staff must be strictly followed. During training, “skills.lab” may only be left upon request.

Standing and moving outside the playing field, in the ball trenches as well as in the ejection area of the ball machines is prohibited. The marked field must not be left. Each user has to pay particular attention to not run or fall into the ball trenches. During operation, “skills.lab” uses class 4 lasers. The lasers are installed in a sufficient distance for the standard use of “skills.lab“. Looking directly into the laser projectors (moving-head) is prohibited.

Exercise of sport is generally associated with an increased risk of injury and accidents. Balls ejected from ball machines can cause serious injuries even if properly operated and maintained. Due to the specific texture of the artificial turf, skin abrasions and burns may occur.

The liability of the operator and the “skills.lab” staff for damages of all kind resulting from training as well as for damages which may arise during the exercise of sport is excluded, unless the damage was caused by the intentional misconduct or gross negligence of the operator or “skills.lab” staff. Claims of the club or employer of a user against the operator or “skills.lab” staff are excluded. The user is responsible for complying with the training safety requirements.

All equipment must be handled with diligence and care. The user is fully liable for all damages to or loss of “skills.lab” equipment to the extent caused by the user’s gross negligence or willful misconduct.

If the user becomes aware of any defects in or malfunctions of the “skills.lab” system or any other system-relevant components (balls, etc.), the user shall inform the “skills.lab” staff immediately.

§  4 Prices and cancellation
Prices are set out in Euro including VAT. Training units can be paid cash or by credit card. Annual subscriptions can also be paid by transfer form.

Users can cancel booked units free of charge up to four days before scheduled date. If cancellation takes place within four days and one day before the scheduled date, 50% of the invoice amount will be charged as cancellation fee. Cancellation fee for cancellations on the scheduled day will be 100% of the invoice amount.

The operator is free to cancel scheduled appointments at short notice for important reasons. In this case, the operator and the user will agree on an alternative date for the canceled training unit.

§  5 Pictures, video recordings and data

During training in “skills.lab“, the data of the training unit is recorded. The data is stored anonymously and will be used for research and development purposes, for statistical evaluation and for marketing purposes without any further consent from the user.

The use of pictures, videos and other non-anonymous data requires the explicit consent of the user and, if applicable, its employer.

skills.lab” processes and uses the personal data of the user exclusively internally, in particular for the administration of trainings, according to the provisions of the Data Protection Act. In any event, “skills.lab” handles data strictly confidential and does not pass it to third parties.

skills.lab” is monitored by means of a video surveillance system. The data retrieved from video surveillance is only used according to the provisions of the Data Protection Act (e.g. transmission of data if the documentation of a criminal offense is suspected).

§  6 Final provisions

Should any provision of these terms of use be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be deemed replaced by such valid provision coming closest to the purpose of the agreement that the parties would have agreed on to achieve the same economic result, if they had known of the invalidity of the provision.

The use of “skills.lab” and these terms are exclusively governed by Austrian law, excluding the CISG. All claims relating to the business relationship shall fall under the jurisdiction of the courts in Graz, Austria. Consumers within the meaning of applicable consumer protection law are entitled to use their general place of jurisdiction.
